Terms and Conditions

1. The Client ("you") is requesting the provision of MyMappingBuddy(tm) ("The Service") as a home search service using a Mapping API Service (e.g. GOOGLE MAPS) chosen by Blue Fire Group, and IDX data that is provided by the Client's MLS. The Service will be provided to the client as a FRAMED web service that can be provided to users via the Client's web site.

2. The Client understands that the provision, specification and availability of the Service is entirely dependant on the continuing availability of the Mapping API Service provided to Blue Fire Group by the chosen Mapping API Service supplier.

3. Pricing is subject to change, and depends on any changes to pricing imposed by, but not limited to, the Mapping API Service supplier, or any changes imposed by the IDX data provider (your MLS) for the IDX data, or any changes in operating environments.

4. The Client must have a valid IDX agreement (or similar) signed with their MLS.

5. Limitation of Liability
Blue Fire Group Inc responsibilities are defined by, and restricted to, those items expressly defined in the Features of My Mapping Buddy, specifically the provision of IDX data from the Client's MLS and the provision of the programming interfaces to the GOOGLE Mapping Interface.
Blue Fire Group, Inc. assumes no responsibility for interruptions to the provision of My Mapping Buddy ("The Service") that is beyond its control, but will make reasonable efforts to resolve such problems.
Blue Fire Group, Inc. does not guarantee response times or performance levels of the Service, but will make reasonable efforts to ensure the Service remains competitive.
Blue Fire Group, Inc. does not guarantee the completeness of the data. The Client accepts that the Service is provided using the best available data supplied from the MLS.
Blue Fire Group, Inc. assumes no liability for the content (text, images, photos, contact information, latitude, longitude and MLS numbers).
The Client agrees that Blue Fire Group, Inc. has made no guarantees as to the performance, success or return on investment of The Service.
The Client agrees that The Service may be modified or changed at anytime, by Blue Fire Group, Inc., to meet market needs. Blue Fire Group, Inc. is not obligated to notify the Client in advance of any significant enhancements or changes to The Service.
BFG does not represent or warrant that the Service will work with browser software other than Microsoft Internet Explorer version 5 or later and AOL version 6 or later

6. Indemnity.
The Client agree to release, indemnify, and hold Blue Fire Group Inc., its contractors, agents, employees, officers, directors and affiliates, and third party providers harmless from all liabilities, claims and expenses, including attorney's fees, of third parties arising out of or relating to the use of the my Mapping Buddy service that you are subscribing to and providing to consumers through your web site including without limitation infringement by you or a third party with access to your Account Identifier and Password. When we are threatened with suit by a third party, we may seek written assurances from you concerning your promise to indemnify us; your failure to provide those assurances may be considered by us to be a breach of your Agreement and may result in the suspension or cancellation of any or all Service(s). This indemnification obligation will survive the termination or expiration of this Agreement.

7. Abuse of Services
We will monitor use of our system. Anyone using myMappingBuddy.com expressly consents to such monitoring.
Improper use of the myMappingBuddy service can result in the following:
a) A warning from Blue Fire Group, via email or phone.
b) Temporary or Permanent disconnection of service.

8. Payments
All payments must be made by credit card.

9. Automatic Credit Card Billing
The Client ("you") authorizes Blue Fire Group Inc. to automatically bill your credit card every month.

10.Cancellation
You may cancel this service and automatic billing at any time by providing 1 month's notice of such cancellation.
The Client understands that Blue FIre Group may terminate The Service at any time.
